Terms of Service

The terms of our relationship, plainly stated.Last updated July 2026

Welcome to Giselle. These Terms of Service (the "Terms") are the agreement between you and Giselle LLC ("Giselle," "we," "us," or "our") for your use of the Giselle app and its features (the "Service"). Please read them — they include, in Section 12, an agreement to resolve disputes through binding arbitration and a waiver of class actions.

By creating an account or using Giselle, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.

Who may use Giselle

Giselle is designed for adults. You must be at least 18 years old and able to enter into a binding contract to use the Service. By using Giselle, you confirm that you meet these requirements.

Your account

To use Giselle, you'll create an account with your name and email. You're responsible for the accuracy of your account information, for keeping your login credentials secure, and for activity that happens under your account. Please tell us promptly at hello@heygiselle.com if you believe your account has been used without your permission.

Membership, free trial, and billing

Giselle is a paid membership (the "Membership").

Pricing. The Membership is $19 per month or $190 per year, at the plan you choose.

Free trial. New members are offered a 14-day free trial. If you don't cancel before the trial ends, your Membership begins automatically and billing starts.

How you're billed. The Membership is sold as an in-app purchase through the Apple App Store or Google Play, depending on your device. Payment is charged to your app store account at confirmation of purchase or at the end of your free trial. Your Membership renews automatically — monthly or yearly, matching your plan — at the then-current price, and your app store account is charged for each renewal, until you cancel.

Canceling. You manage and cancel your Membership through your app store account settings (Apple or Google) — not within Giselle. To avoid being charged for the next period, cancel at least 24 hours before your current period or free trial ends. Because your purchase is handled by the app store, any refunds are governed by the app store's policies, and we are not able to process app store refunds directly.

Price changes. We may change Membership prices. If we do, the new price applies to your next billing period, and we'll give you notice as required by the app store and applicable law.

What Giselle does — and what she doesn't

Giselle prepares and hands off. She creates briefings, drafts, and suggestions for you to review. She is not autonomous: Giselle does not send emails or messages, and does not book, buy, confirm, or otherwise transact on your behalf. When something is ready, you review it and send or act on it yourself, from your own apps and accounts. You are responsible for anything you choose to send, schedule, book, or do based on Giselle's help.

Giselle is not professional advice. Giselle's briefings, drafts, and suggestions are for your personal convenience only. They are not medical, financial, legal, or other professional advice, and you should not rely on them as a substitute for a qualified professional. For decisions that matter, please consult the right expert.

A word on AI. Giselle uses artificial intelligence to generate drafts and briefings. AI can be inaccurate or incomplete, so please review Giselle's output before you rely on it or send it on.

Using Giselle responsibly

We ask that you use Giselle lawfully and respectfully. You agree not to:

  • Use the Service for any unlawful purpose, or in violation of these Terms;
  • Infringe or misuse anyone else's rights, including privacy and intellectual-property rights;
  • Provide another person's personal information unless you have the right to do so (for example, when you add a friend's birthday, you confirm you're entitled to share it);
  • Upload malicious code, or attempt to disrupt, overload, or compromise the security of the Service;
  • Reverse-engineer, decompile, scrape, or attempt to extract the source code of the Service, except where the law expressly permits it; or
  • Use the Service to harass, harm, deceive, or impersonate others.

Your content

You own your content. The notes, tasks, facts, and other information you put into Giselle are yours. We claim no ownership of them.

The permission we need. To run the Service for you, you grant Giselle LLC a limited, non-exclusive, worldwide, royalty-free license to host, store, process, transmit, and display your content solely to provide and improve the Service for you — including sending it to the providers described in our Privacy Policy (such as Anthropic/Claude) so Giselle can turn it into your drafts and briefings. This license exists only so Giselle can do her job, and it ends when you delete your content or your account, except for residual backup copies made in the ordinary course and anything we're required to keep by law.

Your responsibility. You confirm that you have the rights to the content you provide, and that it doesn't violate the law or anyone else's rights.

Our intellectual property

Giselle — including the app, its software, design, features, and brand (everything except your content) — belongs to Giselle LLC and is protected by intellectual-property laws. We grant you a limited, personal, non-transferable, non-exclusive, revocable license to use the app for its intended purpose while your Membership is active. These Terms don't give you any other rights in Giselle.

Third-party services and the app stores

Giselle connects with services provided by others — including your calendar provider (Google, iCloud, or Outlook), your weather sources, and the app stores. Your use of those services is governed by their own terms, and we're not responsible for them.

Because Giselle is distributed through the Apple App Store and Google Play, you also agree that:

  • These Terms are between you and Giselle LLC only, not Apple or Google. Giselle LLC — not the app stores — is solely responsible for the Service and its content.
  • The app stores have no obligation to provide support or maintenance for Giselle. If you need help, contact us at hello@heygiselle.com.
  • To the extent required by their rules, Apple and Google (and their subsidiaries) are third-party beneficiaries of these Terms and may enforce them against you.
  • You represent that you are not located in a country subject to a U.S. embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. government restricted-party list.
  • You will comply with any applicable third-party terms from the app store when using Giselle.

Disclaimers

We put real care into Giselle, but the Service is provided "as is" and "as available," without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that Giselle's drafts, briefings, or suggestions will be accurate or complete. You use the Service at your own discretion and risk.

Limitation of liability

To the fullest extent permitted by law, Giselle LLC and its owners, members, and personnel will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Service.

To the fullest extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of the amount you paid us for the Membership in the 12 months before the claim arose, or one hundred U.S. dollars ($100).

Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you. In that case, our liability is limited to the smallest amount the law allows.

Indemnification

You agree to indemnify and hold harmless Giselle LLC and its owners, members, and personnel from any claims, damages, losses, liabilities, and reasonable expenses (including attorneys' fees) arising out of or relating to your content, your use of the Service, your violation of these Terms, or your violation of any law or the rights of any third party.

Governing law and dispute resolution

These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-laws rules.

Let's talk first. If you have a concern, please email us at hello@heygiselle.com so we can try to resolve it informally. Most issues can be settled quickly this way.

Binding arbitration. If we can't resolve a dispute informally, you and Giselle LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration, rather than in court, except as noted below. The arbitration will be administered by the American Arbitration Association under its applicable consumer rules, and will be seated in Davidson County, Tennessee. Judgment on the award may be entered in any court of competent jurisdiction.

Class-action waiver. You and Giselle LLC agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding.

Exceptions. Either of us may still (1) bring an individual claim in small-claims court if it qualifies, and (2) seek injunctive or equitable relief in court to protect intellectual-property rights or address unauthorized use of the Service. For any matter not subject to arbitration, you agree to the exclusive jurisdiction and venue of the state and federal courts located in Davidson County, Tennessee.

Your right to opt out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing hello@heygiselle.com with your name and a statement that you wish to opt out. Opting out won't affect any other part of these Terms.

Termination

You can stop using Giselle at any time and delete your account (see our Privacy Policy for how deletion works; remember that Membership billing is managed through your app store).

We may suspend or end your access to the Service if you breach these Terms, or where we reasonably need to for legal, security, or operational reasons. When your access ends, the license we grant you in Section 7 ends as well. Sections that by their nature should survive — including Sections 6, 9, 10, 11, and 12 — will continue to apply.

Changes to these Terms

We may update these Terms from time to time. When we do, we'll post the updated Terms and revise the "Last updated" date above, and for material changes we'll give you reasonable notice within the app or by email. Your continued use of Giselle after an update means you accept the revised Terms.

General

These Terms, together with our Privacy Policy, are the entire agreement between you and Giselle LLC regarding the Service. If any provision is found unenforceable, the rest will remain in effect, and the unenforceable provision will be applied to the fullest extent permitted by law. Our not enforcing a provision isn't a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
